The U.S. Securities and Exchange Commission (SEC) has overhauled its listing rules, a move that is expected to open the floodgates for a new wave of crypto-based Exchange-Traded Funds (ETFs). This decision by the SEC allows for a more streamlined and efficient approval process for these products, a stark contrast to the lengthy, case-by-case reviews that were previously required. The new framework will enable exchanges to adopt generic listing standards, eliminating the need for a separate, individual approval for each new crypto ETF. This change is a significant win for the cryptocurrency industry and investors.
The core of the new framework is a set of generic listing standards that new ETFs must meet. The most important of these standards is that the underlying cryptocurrency asset must have an associated futures market on a regulated exchange for at least six months. This requirement is a key indicator for the SEC, as the existence of a robust futures market provides a basis for surveillance and helps to mitigate concerns about market manipulation. This new rule is a major step forward from the previous approach, which often required a court order or extensive legal battles to approve a crypto ETF.
The new rules are expected to drastically cut down the time it takes for a new crypto ETF to go from filing to launch. Previously, the process could take up to 240 days, but under the new, streamlined framework, the timeline could be as short as 75 days. This acceleration will lead to a "deluge" of new crypto ETFs, with some analysts predicting over 100 new products launching in the next year. This will give investors a much wider range of options to gain exposure to digital assets through a familiar and regulated investment vehicle.
The SEC's decision comes after years of a cautious, and at times, hostile approach to cryptocurrency. The new stance is largely seen as a result of a change in leadership at the SEC and a more crypto-friendly administration. The move is also a response to the growing demand for crypto products from both institutional and retail investors.
